Terms of Sales

These terms of sale (hereinafter the "Terms of Sale") govern the relationship between the company SCV Domaine Skiable (hereinafter "SCV"), operator of the ski lifts of the Serre Chevalier ski area, and any consumer (here -after the "Customer") who:

  • Purchases from SCV or one of its agents a ticket (hereinafter a "Pass(es)") allowing use during the winter season of one or more ski lifts operated by SCV; Where

  • Book an activity (hereinafter an "Activity") marketed by SCV or one of its agents and to be performed during the winter season;

  • Takes out insurance (hereinafter an "Insurance") offered by SCV and attached to a Ticket.

By purchasing a Ticket, reserving an Activity or subscribing to Insurance, the Customer unreservedly accepts the Conditions of Sale.
As an exception, the order of a Ticket or an Insurance via the website https://www.ouik-serrechevalier.ski is governed by the conditions of sale appearing on this website.

ARTICLE 1. INFORMATION ABOUT SCV

SCV is a simplified joint stock company with capital of 15,012,460.40 €, registered at the RCS (Company Trade Register) of GAP under the SIREN number 348 799 529, and with the Intra-community VAT number : FR 41 348 799 529.

Its information is :

SCV is insured by Allianz IARD (1 cours Michelet, CS 30051, 92076 Paris La Défense Cedex, France).

It is registered as an insurance intermediary agent under Orias number 20000112.

ARTICLE 2. PASSES, ACTIVITIES AND INSURANCES

Passes and Activities, their caracteristics and terms and conditions are listed in the Pass Offices of SCV (below « Pass Office(s) »), on the Pass Dispensers operated by SCV (below « Pass Dispenser(s) »), as well as on the website https://www.serrechevalier-pass.com/ (below « Website »).

The Passes and Activities are only available for the summer season in which they were ordered.

Activities can only be booked for a determined date and time. To participate in an Activity, it is necessary to to have a valid « pedestrian » Pass. The Customer must ensure that the registered person possesses such Pass and, if applicable, purchase a this Pass. Gear and equipment is included with Activities and cannot be rented inseparably from Activities.

ARTICLE 3. PASS OFFICES

Passes can be purchased at Pass Offices and, for a selection of Passes only, on the Website and at Pass Dispensers. Free Passes for people aged 75 or over, as well as free Passes for people with reduced mobility, can only be obtained at Pass Offices.

Activities can be booked at Pass Offices and on the Website.


Insurance can be taken out at Pass Offices, on the Website and at ATMs.


Certain offers may be presented exclusively at the Pass Offices, on the Website or on the Pass Dispensers.

ARTICLE 4. ORDER

The Customer cannot purchase more than eight Passes per order on a Pass Dispenser.

The Customer can finalize the order of a Pass on a Website no later than the day before the start of validity of the Pass. However, if he chooses to receive by post the keycard on which the Pass is encoded, the order must be confirmed and paid in full at least seven clear days before the start of validity of the Pass in the event of dispatch to mainland France or Corsica, at least ten clear days before the start of validity of the Pass in other cases. Otherwise, the order cannot be finalized.

An Activity can be reserved on the Website until the day of the start of this Activity, within the limit of available places.


When placing an order on the Website, the Customer:


1. Selects the Pass(es) or Activity(ies) they wish to order;

2. Checks his order, if necessary modifies it, then validates it;

3. Create a personal account (if he does not already have one) then fill in his identifiers to access his personal account, or choose to order without creating a personal account and fill in his email address;

4. Provides the information needed to personalize the Passes and Passes for the Activities;

5. Chooses the terms and conditions for issuing Passes and Activity Passes;

6. Accepts the Terms of Sales and the terms of use of Passes and Activities;

7. Pay for his order.


Once the order has been paid for, the Customer receives an order confirmation message by email.

ARTICLE 5. PHOTOGRAPHY

In the event of the purchase of a Pass valid for the entire winter season or a free or "veteran" Pass, the Customer must provide a photograph of the user of this Ticket. It must be a recent identity photograph, full face, without tinted glasses or headgear.

ARTICLE 6. PRICE

The price of Passes and Activities is available in Pass Offices, near and on Pass Dispensers, on the Website, as well as in the Tourism Offices of Serre Chevalier.

They are written in euros and all tax included. They can be modified during the season in cas of variation of these taxes.

A price discount is not combinable with another price discount.

If the Customer would like to benefit from a discounted price or a free Pass, the Customer must present, when getting the Pass or the Activity in a Pass Office or one of SCV agents, an original document attesting that the user of the Pass or the person registered for the Activity fits the terms to benefit from this reduced price or free Pass at the beginning of the validity of said Pass or Activity. The user or person registered must be able to present these documents at any time during the entire duration of the Pass or Activity, whether the Pass or Activity has been obtained in a Pass Office, on a Pass Dispenser or on the Website. No printed copy or digital copy is admitted.

SCV is likely to only offer Passes at a discounted rate at the Pass Offices, in particular in the event of unfavorable weather or snow conditions having a significant impact on the opening of the ski lifts.

No price discount or free Pass is given after the purchase of a Pass or an Activity has been completed.

Unless otherwise stated, the price of Activities includes necessary gear and equipment to participate in these Activities. However, the « pedestrian » Pass, necessary to participate in Activities, is not included in the price of Activities.

ARTICLE 7. PAYMENT

7.1. Currency

Payment for Passes and Activities must be made in euros.


By way of exception, the Customer may pay at Pass Offices and on the Website in a currency other than the euro by using the DCC (Dynamic Currency Conversion) service.


7.2. Means of payment

The accepted means of payment are:


- At the Pass Offices: bank cards (Carte Bleue, Visa, Mastercard, American Express), checks drawn on a bank account opened in France and issued to the order of SCV, cash within the legal limits, printed ANCV holiday vouchers;

- On the Website: bank cards (Carte Bleue, Visa, Mastercard, American Express), digital ANCV holiday vouchers (Connect holiday vouchers);

- At Pass Dispensers: bank cards (Carte Bleue, Visa, Mastercard).


In case of payment by check, the Customer must present an original identity document in his name.


The splitting of the payment into several means of payment is possible only in the event of an order at the Pass Offices or on the Website.

7.3. Payment in several installments

All orders are payable in full as soon as they are placed.


However, the Customer may pay for his order using a credit, in four installments free of charge, if the following conditions are met:


- The order is for a Pass valid for an adult and for the entire winter season;

- It is carried out no later than 1 December;

- It is carried out on the Website;

- It is paid in full by credit card.


The Customer is then charged a quarter of the price of his order at the time of this order. The second debit of a quarter of the price is made one month later on the bank card whose number the Customer gave at the time of his order. The third debit of a quarter of the price is made one month after the second debit on the same bank card. The balance is debited one month after the third direct debit from the same bank card.


To benefit from payment in several instalments, the Customer must choose the corresponding option during the ordering process.


The Customer must ensure that the bank card is valid until the last due date, and that the amount of each planned direct debit is lower than the ceiling authorized by his banking institution.


The Customer may waive the payment facility provided for in this article under the conditions laid down in article 14. He must then pay his order in cash.


If an order is canceled in accordance with the Conditions of Sale, the use of the payment facility provided for in this article is canceled and the sums paid by the Customer are refunded to him.

ARTICLE 8. ISSUANCE OF PASSES AND ACTIVITIES

Each Pass and each Activity access ticket is issued in the form of a keycard on which it is encoded. This keycard is provided free of charge with the purchase of the Pass or the access pass to the Activity.

If the Customer has purchased a Pass at the Pass Offices, the keycard on which this Pass is encoded is delivered to him immediately at the Pass Offices.


If the Customer has purchased a Pass on the Website, he can:

  • Either collect the keycard on which this Pass is encoded at the Pass Offices. To do this, he must bring an identity document and the number of his order. This number appears in the order confirmation message;

  • Either withdraw the keycard on which this Pass is encoded from a Pass Dispenser. To do this, he must have the e-mail address provided when ordering, as well as the order number;

  • Either collect a blank keycard from one of the collection points listed on the Website. This withdrawal can be made up to the first day of validity of the Pass. The Customer must then connect to his personal account on the Website to encode the Pass on the keycard;

  • Or ask for the keycard on which this Pass is encoded to be sent by post to the address indicated when ordering. Shipping costs are offered.

    If the Customer has purchased a Pass on a Pass Dispenser, the keycard on which this Pass is encoded is delivered to him immediately by this Pass Dispenser.

ARTICLE 9. RELOADING PASSES AND ACTIVITIES

The keycard on which a Pass is encoded can be recharged once or several times. A new Pass can thus be encoded on this keycard, unless it is a Pass valid for the entire winter season. It must be entered no later than thirty minutes before the start of the validity of this Pass.

Reloading can be done at Pass Offices, on the Website and at Pass Dispensers.


In the event of registration on a keycard of a new Pass while the pass which is encoded therein is currently valid, the initial Pass is terminated and can no longer be used, without the Customer can claim any compensation whatsoever. The Customer is therefore invited to wait for the end of validity of the Pass encoded on his card to register a new Pass on this card.

ARTICLE 10. PROOF OF SALE

A proof of sale (below « Proof of Sale ») is issued to the Customer after the completion of a purchase of a Pass or an Activity. In case of a purchase on the Website, the Proof of Sale is the order confirmation email.

The Customer is invited to keep the Proof of Sale during the entire duration of validity of the Pass or the Activity. This Proof of Sale is necessary to ask for any type of compensation.

ARTICLE 11. MODIFICATION OF AN ORDER

The Customer can modify an order free of charge under these terms and conditions :

  • The order has been made on the Website ;

  • The modification is, exclusively, a change of validity date of the purchased Pass or the booked Activity, the new validity date is during the same Summer season that the Pass or the Activity has been purchased for ;

  • The modification does not affect the price of the Pass or the Activity ;

  • The requested modification is received by SCV no later than the first day of validity of the Pass or the Activity ;

  • The Pass has not been used, even partially, or the person booked for an Activity has not participated, even partially, in the Activity after requesting a modification.

If the Pass or the Activity has been reloaded, like described in article 9, there is an exception. In this case,the Pass or Activity cannot be modified. The Customer must cancel the order according to article 12.

The Customer must request a change :

  • Either by email at the following address: contact@serrechevalier-pass.com

  • Either on the website https://www.ticketoski.fr/fr/serre-chevalier.

The customer must include in the request :

  • The reference number of the order ;

  • First and last name(s) ;

  • The number of the card on which the Pass or the Activity is encoded (unless the card has not been acquired yet).

Once the request has been dealt with, the change is valid once the user of the Pass goes through the access points of the lifts.

ARTICLE 12. CANCELLATION OF AN ORDER

The Custoler can totally or partially cancer an order if the following terms are met :

  • The order has been made on the Website ;

  • SCV is informed of the cancellation no later than the first day of the validity of the Pass or the Activity ;

  • The Pass has not been used, even partially, or the booked person has not participated, even partially, in the Activity, included after the cancellation request.

The Customer must request a cancellation :

  • Either by mail at the following address : SCV Domaine Skiable, Service billetterie internet, place du Téléphérique, Le Serre d’Aigle, Chantemerle, 05330 Saint-Chaffrey, France ;

  • Either by email at the following address: contact@serrechevalier-pass.com

  • Either on the website https://www.ticketoski.fr/fr/serre-chevalier.

The customer must include in the request :

  • The reference number of the order ;

  • First and last name(s) ;

  • The number of the card on which the Pass or the Activity is encoded (unless the card has not been acquired yet).

The price of the canceled Pass or canceled Activity is then refunded to the Customer. If the canceled Pass or canceled Activity is included in a « Family Pack » and if the cancellation makes the Customer lose the benefits of the « Family Pack » (because of the number of people left in the order), then the refunded amount equals the price paid by the Customer for the Pass or the Activity, minus the difference between the price of the other Passes or Activities included in the « Family Pack » at the « Family Pack » price and the price of these same Passes or Activities at the public price.

The amount is refunded on the credit card used to purchase the Pass or the Activity, unless otherwise indicated by the Customer. In case of payment by digital ANCV checks, the amount paid using this type of payment is refunded by bank transfer. The refund being based on the price in euros of the order, the changes in value of the currency between the date of the order and the date of the refund are at the charge of the Customer.

ARTICLE 13. REFUND, EXCHANGE, EXTENSION OR POSTPONING OF A PASS OR ACTIVITY

The Customer, the user of a Pass or the person registered for an Activity cannot benefit from any reimbursement or exchange of this Pass or the access pass to this Activity, nor from any extension or 'no postponement of their validity, even if the Pass has not been used or has only been used partially, if the person has not taken part in the Activity, or if the price of the Pass or of the Activity access pass has decreased since the date of its purchase.

By way of exception, the Customer may obtain a refund or postponement of a Pass or an Activity under the conditions laid down in Articles 11 and 12, and benefit from compensation in the cases detailed below.


No compensation is granted to the Customer who has purchased a Pass or reserved an Activity with any person other than SCV or one of its agents. In this case, the Customer must contact the person from whom he purchased the Pass or reserved the Activity.


13.1. Interruption of the operation of the ski lifts for health reasons by decision of the public authorities

In the event of closure for health reasons, by decision of the public authorities, of all the ski lifts operated by SCV for one or more full days, the Customer may request reimbursement of the Pass, the Activity he has ordered (e) from SCV or one of its agents (provided that the Activity requires access to the ski lifts).


The amount reimbursed is calculated in proportion to the number of days of closure pursuant to the administrative decision during the period of validity of the Pass or Activity.


The price of any Insurance taken out by the Customer is not reimbursed.


To obtain this compensation, the Customer must send a request to SCV using the contact details indicated in article 19. This request must be accompanied by the Proof of Sale and, in the event of the purchase of a Pass, a copy of the this Pass.

13.2. Interruption of the operation of the ski lifts for any reason other than a decision of the public authorities taken for health reasons

The Customer may obtain compensation if the following conditions are met:

  • He has purchased from SCV or one of its agents a Pass other than a Pass valid for less than one day, one day, several non-consecutive days or the entire winter season;

  • During the period of validity of this Pass, the operation of more than 75% of the ski lifts to which this Pass gives access is interrupted throughout the day;

  • This interruption is not due to an event of force majeure nor is it the application of the calendar and the opening times of the ski lifts displayed at the Pass Offices or on the SCV Website.

The compensation takes the form, at the Customer's choice:

  • Or the benefit of a new Pass, valid during the season during which the operation of the ski lifts was interrupted. This new Pass is valid for a period equal to the number of days during which the operation of the ski lifts was interrupted during the period of validity of the initial Pass;

  • Or the reimbursement of an amount equal to a fraction of the price of the Pass, excluding Insurance. This sum is calculated in proportion to the number of days of interruption of the operation of the ski lifts during the period of validity of the Pass in relation to the number of days of validity of the Pass (e.g.: the Customer having purchased a Pass valid for six days is reimbursed by an amount equal to 50% of the price of this Pass in the event of interruption of the operation of the ski lifts for three days during the period of validity of this Pass);

  • Or a credit note, the amount of which is calculated as above. This credit is non-transferable and valid until the end of the winter season of operation of the ski lifts by SCV following that during which the operation of the ski lifts was interrupted.

To obtain this compensation, the Customer must send a request to SCV using the contact details indicated in article 19. This request must be accompanied by the Proof of Sale, a copy of the Ticket and a bank account statement.

13.3. Cancellation of an Activity by SCV

If an Activity that he has reserved with SCV or one of its agents is canceled by SCV, the Customer may obtain the postponement of the Activity or the reimbursement of his reservation. If the Customer has purchased an “Activity Pack” allowing him to access several Activities, the amount refunded is equal to the price of the canceled Activity(ies) only.

To obtain the postponement of the Activity, the Customer must present the Proof of Sale to the Pass Offices.


To obtain a refund for his reservation, the Customer must send a request to SCV using the contact details indicated in article 19. This request must be accompanied by the Proof of Sale.

ARTICLE 14. RIGHT OF WITHDRAWAL

The Customer cannot benefit from the right of withdrawal provided for by the French consumer code in case of a purchase of a Pass on the Website or a Pass Dispenser.

The subscription of an Insurance is subject to the provisions relating to the right of renunciation in the event of multi-insurance provided for by the French insurance code. The procedures for exercising this right are detailed on the website https://serre-chevalier.monassuranceski.com

ARTICLE 15. RESPONSIBILITY

It is the Customer’s responsibility to choose the adapted Pass or the Activity meeting the Customer’s needs. SCV cannot be held liable for the inadequacy of the Pass or the Activity chosen for the needs and constraints of the Customer, the user of the Pass or the person registered with the Activity.

ARTICLE 16. PERSONAL DATA

16.1. Purpose and basis of personal data processing

The collected personal data in the event of the purchasing of a Pass or the booking of an Activity is used in order to :

  • Process the order. This process is necessary to follow the contract concluded between SCV and the Customer ;

  • Sending to the Customer promotional messages, newsletters, as well as invitations to participate in games or contests, or satisfaction surveys. This process is, since it is messages sent by SCV, based on the legitimate interest of SCV to develop its activities. It is also, for messages sent by SCV agents (Tourism Office of Serre Chevalier, business partners, SCV affiliated businesses) based on the consent of the Customer by checking the box intended for this purpose ;

  • Meet the Customer’s needs in terms of information, comments and claims. This process is based on the consent of the Customer.

16.2. Data controller

The processes mentioned above are followed under the responsibility of SCV, represented by its general director, which information is mentioned in article 1.

16.3. Recipients of personal data

The collected data are destined to SCV, and to service providers who need the data in order to follow the processes described above and, if the Customer allows it, to SCV partners (Tourism Office, business partners, SCV affiliated businesses).

This data could potentially be transfered to a country outside of the European Union. The Customer can request information about this transfer and the warranties applicable to it from SCV.

16.4. Personal data retention periods

The collected data is kept for the following periods :

  • Data used to process an order :

    • For five years, if the order has not been made electronically ;

    • If the order has been made electronically, five years if the amount of the order is below 120€, for ten years if the amount of the order is equal to or above 120€ ;

  • As an exception, the number and expiration date of the credit card used for the order are kept for fifteen months as proof in case of a claim of a transaction dispute. The cryptogram is not kept after the transaction.

  • As another exception, the photograph of the Customer is kept for three years in order to facilitate the reissue of a Pass, provided that the Customer has consented thereto ;

  • Data used to send promotional messages, newsletters, as well as invitations to participate in games or contests, or satisfaction surveys : for three years, this period being renewed at each significant interaction between the Client and SCV (new order, request for information, etc.);

  • Data used to answer the needs of the Customer in terms of information, comments and claims : during the necessary period of time to process these requests, comments and claims.

16.5. Rights of the people whose data is processed

The person whose data is processed can acces the data regarding him or her, modify it, adjust it or erase it, transfer it or make it transfer it to a third party, obtaining limitation of processing or opposing the processing of the data. The person can withdraw consent of processing of the data, withdrawing consent does not, however, affect the lawfulness of the processing carried out before this withdrawal. To exercise these rights, the person must make a request to the Data Protection Officer of SCV, which information can be found in article 19.

SCV will comply with this request subject to compliance with the obligations imposed on it. In order to protect personal data, SCV reserves the right to ask the person for proof of identity before responding to this request.

FInally, the person whose data is processed can make a claim to the Commission Nationale de l’Informatique et des Libertés (CNIL) if the person considers his or her rights are not respected. ARTICLE 17. COMMUNICATION OF THE TERMS AND CONDITIONS OF SALES AND DETAILS OF THE ORDER

The Customer can obtain a copy of the Terms and Conditions of Sales.

Furthermore, if the Customer has made an order electronically, it is possible to get details about this order, as well as the Terms and Conditions of Sales applied to the date of the order, for 5 years following this order if the amount of the order is below 120€ tax included, 10 years if the amount of the order is equal to or above 120€ taw included.

To do so, the Customer must make a request ot SCV using the contact info mentioned in article 19.

ARTICLE 18. FOLLOW-UP OF AN ORDER

In case of the purchasing of a Pass on the Website, the Customer can obtain information about the order :

ARTICLE 19. CLAIMS AND REQUESTS

The Customer can make a claim or request regarding the processing of his or her personal data :

  • Either by email to this email address: scv.dpo@compagniedesalpes.fr ;

The Customer can address any other claim or request, within two months of the occurring event leading to the claim or request :

  • Either on this website : https://www.ticketoski.fr/fr/serre-chevalier.

ARTICLE 20. SETTLEMENT OF DISPUTES

In case of a dispute between the Customer and SCV regarding the validity, the interpretation, or the execution of the Terms and Conditions of Sales, the Customer may have free recourse to a conventional mediation procedure or any other alternative method of dispute resolution.

He can resort to a mediation procedure with the Médiateur du Tourisme et du Voyage (MTV Médiation Tourisme Voyage, BP 80 303, 75 823 Paris Cedex 17, France – Phone : +33 (0)1 42 67 96 68 – Email address: info@mtv.travel) according to the procedures set out on the website https://www.mtv.travel and within a maximum period of one year from the written complaint made to SCV.

The Customer can also use the online dispute resolution platform set up by the European Commission, accessible on the website https://webgate.ec.europa.eu/odr/.

In the absence of an amicable settlement, the Customer may seize either one of the courts with territorial jurisdiction under the French Code of Civil Procedure, or the court of the place where he lived at the time of the conclusion of the contract or the occurrence of the harmful event.

ARTICLE 21. ENTRY INTO FORCE OF THE TERMS AND CONDITIONS OF SALES

The Terms of Sales enter into force on June 30th, 2023.

ARTICLE 22. MODIFICATION OF THE TERMS AND CONDITIONS

SCV reserves the right to modify the Terms of Sales at any time.

ARTICLE 23. TRANSLATION OF THE TERMS AND CONDITIONS OF SALES

In case of contradiction between the Terms of Sales in French and the Terms of Sales in another language, the Terms of Sales in French prevail.

ARTICLE 24. APPLICABLE LAW

The Terms of Sale are governed by French law.
